TERMS &

CONDITIONS

ARTWORK
All artwork must be submitted to artwork@groundupmedia.co.uk as per the Artwork Deadlines on your media plan (unless otherwise specified in writing). Late supply of artwork may incur additional charges, result in display delays, or, where deadlines are missed, result in forfeiture of the booked display. In such circumstances, no compensation or refund will be due, and payment will remain due in full. All artwork is accepted by us on the condition that it is copyright-cleared, has been proofread by the client, and is in all respects ‘print-ready’. Ground Up Media will not accept responsibility for artwork that is not delivered to the required specifications.

OUT OF HOME POSTING SCHEDULES
You understand that for non-digital assets, posting may take place either side of the “in-charge” date as per the posting schedule. The posting schedule may be altered due to force majeure circumstances beyond our control, such as adverse weather conditions.

ASSET DELIVERY FOR DIGITAL MARKETING SERVICES
To ensure the timely start of digital campaigns, please ensure assets are delivered 7 days prior to campaign start dates. If assets are delivered late, the client understands that this may affect the rollout of the campaign.

PAYMENTS AND CANCELLATIONS
The Price excludes Value Added Tax (VAT), which the Client will additionally be liable to pay to Ground Up Media.

The Client will pay Ground Up Media’s invoices within the payment terms specified on the invoice at the point of issue.

New clients will be required to pay 100% in advance of campaign delivery. Upon successful completion of trade credit checks, new payment terms may be agreed.

For all project-based Digital Marketing Services, we require full payment in advance before any ads can be run from our account. Retainer clients will be invoiced one month in advance of services provided, with payment due within 30 days of the invoice date. Failure to make timely payment may result in a suspension of services until payment is received.

If the Client fails to make payment by the due date, the Client will pay interest on the amount due at a rate of 8% per annum above the Bank of England base rate. Interest will accrue daily from the due date until payment is received. The Client will pay the interest together with the overdue amount.

From time to time, we may change these Terms and Conditions. Any such amended Terms and Conditions will appear here. We therefore recommend that you review the Terms and Conditions on a regular basis.

Cancellation up to 60 working days prior to the Campaign Start Date = 50% of the total Campaign cost.

Cancellation within 60 working days prior to the Campaign Start Date = 100% of the total Campaign cost.

Please note that third-party media owner cancellation policies may differ from the above and, if so, we are bound by their terms and conditions and the client will be liable for any cancellation fees incurred. If in doubt, please confirm the policy with your GUM representative before signing this booking form.

PHOTOGRAPHY
An example selection of photographs will be emailed to you upon campaign completion. We aim to report on all campaigns within 2 weeks of campaign start dates. Please note that we do not guarantee a proof-of-posting photo for every poster site, and most media owners do not provide POP photography for Digital Out of Home (DOOH) assets. Ground Up Media cannot accept responsibility for the quality of proof-of-posting photos supplied by third-party media providers or where third-party suppliers do not provide POP photos. If professional photography is required, please discuss this with your sales representative upon booking and we will be happy to assist. Any issues must be raised within 14 days of campaign completion.

LIABILITYGround Up Media Ltd will not be liable for an amount greater than the specific campaign costs in relation to the services rendered.

Ground Up Media Ltd shall not be held liable for any damage, defacement, or destruction of advertisements caused by acts of vandalism, including but not limited to graffiti, tearing, or physical alterations by third parties.
